Will I get a W-2 because I worked Election Day?

In most cases the answer is NO you will not get a W-2 because Election Fees are not subject to federal income tax withholding. However, if the earnings are over $600.00 in a year they must be reported to the IRS. Payments made to an election judge are not subject to FICA withholding unless the earnings are over $1,100.00 in a year. It is doubtful that the Election Fees earned in a year will reach the $600.00 amount so in most cases the election fees would not be reportable for W-2 purposes or 1099-Misc.

Do I have to report the Election Fees/Earnings if I don't get a W-2?

Yes. According to the IRS you must still report the earnings on your personal tax return. The Election Fee(s)/earnings would be listed on Line 21 - Other Income of the 1040 return.

If you are a regular or temporary employee of Gilpin County, the amount of the Election Fee(s) are already included in your W-2 earnings.
